The penalties are harsh because the outcome of an accident caused by a DUI is harsh. Phoenix law wants to send a strong message to anyone who considers driving while under the influence. If you are charged with a DUI in Phoenix the police and the prosecutor are going to charge you with everything that happened or may have happened.

If you or someone you know has been accused of a DUI in Phoenix you will need a knowledgeable DUI lawyer. You need a lawyer who knows the DUI laws in Phoenix and can prepare the best defense possible for your case.

DUI stands for Driving Under Influence. The ‘Influence’ does not have to be alcohol. It may be a drug that you have in your system. It does not even have to be an illegal drug. The drug could be the new medication that your doctor recently prescribed and you may not even be aware that it was going to cause impairment if you drove while taking it.

Not all cases are the same and you will want a DUI lawyer who understands and takes time to review all the aspects of the charges and the events that occurred when you were stopped. And if you were driving while under the influence of alcohol or a drug substance in Phoenix, you will want to be sure that the penalties that the prosecutor is seeking in your case are fair and reasonable for the charges that you have been accused of. Your lawyer will be able to review this with you and work to prepare your defense with this in mind.

To prepare for your defense, your lawyer will discuss the events with you thoroughly to gain as much information about what happened before, during, and after your traffic stop. Your DUI lawyer also knows that there are issues associated with your case that are time-sensitive and need to be addressed right away. There will be reports and test results that will need to be reviewed as quickly as possible.

In the rush to find a lawyer you may think to call a law firm because you heard their name on a radio or TV commercial. Often those well advertised law firms get a lot of calls from their ads and they may be able to take on your case too but sometimes they have more cases than they have time for.

If you or someone you know has been charged with a DUI in Phoenix, choose a DUI lawyer who makes time to work with you, who gives you the best legal advice possible, has the knowledge to plan the best defense against your charges, who takes into consideration all the aspects involved in your case, is available and ready to answer your questions, and stands by you through the whole process.

If you have partied late into the night and start driving under the influence of alcohol, you are liable for the main kind of DUI in Phoenix.

But to be charged with DUI in Phoenix, it is not necessary that you must have consumed alcohol. Strict Phoenix laws also include consumption of prescription drugs as part of DUI. Because of such strict laws one must be careful while trying to drive.

You are usually stopped for DUI in Phoenix when you commit any traffic infraction like speeding or refusing to yield. An accident is another situation where you will be stopped and checked. You will be checked for alcohol odor or watery and bloodshot eyes. These are signs of ingestion but not real impairment.

For establishing a case, you will have to undergo a field sobriety test. The officer will observe how you move, how you hand out your license and any speech impairment. A toxicology test will be carried out to test whether you have consumed prescription drugs.
When caught under DUI in Phoenix, the first point to note is to be courteous and respectful. The second thing is to request for a DUI defense attorney. This request may not be granted but it is always wise to make use of a DUI defense attorney as it will determine whether there is a case against you or not.

24 hours in jail is a minimum sentence for a minor DUI in Phoenix, if found guilty. This can rise to 30 to 45 days if there is more impairment and serious cases will result in 180 days behind bars.

Hiring a DUI defense attorney will have a great impact on your case. Some people think that they are very smart and want to represent themselves. They will surely fail as they do not have the experience or expertise for handling such situations. A DUI defense attorney will save you from the repercussions of a DUI in Phoenix case.

The fees for such attorneys will vary and you have to select one suitable to your budget. Remember that a few hundred dollars spent will save you from a lot of trouble like a jail term or a hefty fine. The tests that you underwent when caught for DUI Phoenix may have errors especially the blood and chemical tests. In many cases the equipment may have been damaged and this will build up the case in your favor.

Hiring a good DUI defense attorney will help you to pin point such mistakes. After being caught for a DUI in Phoenix, you may have the last laugh with the help of a good DUI defense attorney.

U.S. law is precise and demanding. But some of the laws are flexible and have large gray areas. DUI law is NOT one of them.

Time Bound Laws
In case, you or your loved one is apprehended while driving under the influence of alcohol or drugs or a combination of both in Phoenix, Arizona, a DUI lawyer must be amongst the first people you call. This is because there are many time based restrictions and contentions in DUI law that need to be met. If these are not met in time and in a professional manner, chances are high that your vehicle will be impounded, an anti-drunk driving device fitted in it, and you might also face a temporary or permanent revocation of your driving license that goes on your record. Some laws have criteria that need to be addressed within two hours before the statute of limitations kicks in. A lawyer hired immediately will be your savior in the long run.

Choose Your Route Out
In case of Drunk Driving Defense Phoenix, there are many law firms to pick and choose a DUI attorney from. The lawyer and law firm chosen have to be very well versed with the intricacies of DUI and DWI law in the state of Arizona. Lawyers from Weingart Law are known to be the most experienced at dealing with Drunk Driving Defense Phoenix.

Severe DUI Charges & Convictions
There are cases in which a DUI arrest may lead to severe charges like felony, aggravated misdemeanor, and manslaughter. In cases like these, the dictated law gets convoluted. Chances of conviction also are higher when you are forced to confront a jury. The tasks of handling of all the paperwork, preparing a strong case and of most importance, keeping you out of jail is best handed over to the Weingart Law team of lawyers who are simply the best in Drunk Driving Defense Phoenix.

A long journey of strife and agony awaits the person who is charged with DUI in Phoenix. An excellent Drunk Driving Defense Phoenix style is the only route to salvation.

If you are charged with a DUI in Phoenix, one of the first things you should do is contact a law firm to hire a DUI attorney. While some people choose to represent themselves in these kinds of cases, having an attorney who specializes in DUI charges can make certain that your rights are protected and you get the help you need. An attorney from a Phoenix law firm that works with DUI cases will have the resources and expertise to ensure that justice is served. All attorneys should know how to research the law to determine how it applies to your case, but not all of them have the immediate knowledge and experience that can make or break your case. You wouldn’t hire a veterinarian to perform open heart surgery on your mother, so why would you hire a bankruptcy or divorce lawyer to represent you in a DUI case? Aligning yourself with an experienced professional is always going to be a safer, wiser choice.

Since most Phoenix courts require the completion of DUI cases within six months of when the incident occurred, you will need to find an attorney who will be able to work within this time frame. A law firm may appear to be the best option because it is the most popular, but sometimes more clients just means less time with each one. Be sure you choose someone who will be willing and able to put in the time required to truly help you. You also want to make your hiring decision objectively, which can be difficult under the circumstances. Do not let a shady law firm or DUI attorney take advantage of your vulnerability at this time; hire someone you genuinely trust.

In simple terms DUI is driving under the influence of alcohol or other drugs. If caught by officers under the suspicion of a DUI in Phoenix and proven guilty, it could result in serious penalty. Not only is it serious but also remains in your record for ten years. This could lead to a cash penalty as well as your insurance going up.

If you are charged with DUI in Phoenix, you need to get yourself a lawyer who will help you to fight the charges. The important question is how to hire a lawyer in Phoenix if you receive a DUI citation. The penalty of citation would definitely depend on the degree of influence of alcohol on you. If you are caught for the first time, and you were just over the threshold, your citation may not be that high. On the contrary if you were so dead drunk that your condition not only posed a threat to your life but to other fellow drivers in the streets, the citation could be as high as imprisonment, cash penalty and you may also be abstained from driving for a while.

In either of the cases you have the right to hire an attorney. It is essential to hire an attorney, who’s well informed of the State laws in which you have received a citation. Instead of battling it out yourself it would be helpful to hire lawyers who would be adept at dealing with the State court system and rules, provide legal counseling and guide the defendant accordingly so that he or she may be give the least amount of penalty, as well as understand the seriousness of the issue. In Phoenix attorneys under Weingart Law are known to be one of the best in handling a DUI case in Phoenix and help the defendant greatly to get attorneys from the law firm as they are empathetic to the situation while guiding you the right way.

Because of the harsh DUI laws in Phoenix, one of the scariest things that can happen to you is to get pulled over for a DUI. The punishments for a DUI violation in Phoenix are significantly greater than those for the same infraction in other cities. This is because cracking down on DUI offenses are a big concern of people in the area and because they do not know how to actually reduce the amount of drunk driving in the area. Their alternative is to make the punishments harsher, even though this is not necessarily the most effective way to convince people that they should not drive while under the influence.

If you are caught driving when you are not sober and end up with a DUI, you should not take you chances with your legal fate and you should hire a lawyer immediately. A DUI lawyer will know the law specific to the Phoenix area, and this will help your case when it comes to taking advantage of legal loopholes to reduce your sentence. Because a DUI infraction can have serious financial and legal repercussions, you should not take your chances trying to argue your way out of a charge yourself. You should leave that to the types of people who see and handle cases like your own on a regular basis and who know the most efficient ways of dealing with such charges. Because drunk driving and arrests are such a huge issue in Phoenix, there are a lot of resources in the Phoenix area that you can utilize if you are ever in the situation to need advice. It is a good idea to do a lot of research, but it is also wise to act as soon as possible when it comes to dealing with a charge swiftly and efficiently.

There are many consequences that come along with obtaining a DUI charge. Many cities hold some of the same consequences of getting a DUI. However, each city such as Phoenix can have specific guidelines tailored to fit their individual DUI courts. These guidelines have many details and are designed fit your individual circumstance. The problems that occur from getting a DUI in Phoenix can lead to criminal as well as civil proceedings. These two separate proceedings run major risk that includes the lost of time, money, and mental stress that a person should want to avoid. Phoenix DUI laws require that test be done to determine if a person is driving under the influence. Test such as breath, blood, or urine test are administered to the person suspected of driving under the influence. Refusal in Phoenix to take these tests can result in you being served a notice for a 12-month driver license suspension. If the blood alcohol level is .08% or higher in Phoenix, it is considered to be driving while under the influence.

The criminal proceeding part of the law in Phoenix if a person is found guilty includes fines, fees, assessment, and jail time. Also, a person can be subject to probation that can be supervised or unsupervised. Phoenix also has a civil proceeding that can take place. The civil proceeding for DUI in Phoenix starts through the process of going before an administrative officer. The MVD in Phoenix process for this allows a possible suspension of your driver license. The officer who does the arrest may give you a suspension notice or, it may be mailed. For a person who is from out of state this could mean that your privilege to drive in Phoenix can be revoked. This is just a few of the problems that can lead to a long road of agony of getting a DUI in Phoenix.
